Problems of professional development for judges and issues of determining judge’s professional suitability

Abstract

The article deals with the problem of determining the suitability of the judges, which is fundamental in addressing the issues of career growth, bringing to disciplinary responsibility, dismissal.
Considering the practical aspects of judicial activities, the author notes that the feature of the successful activities of the judges is the high professional training, which is determined by competitive selection and appointment of a candidate for the post. Further training is the right and duty of a judge, that corresponds to the responsibilities of States to implement these rights. The author notes the gaps in legislation and makes concrete proposals for additions to the regulations and improve judicial practices.
