Abstract

In the article the author examines current issues in the law of Poland, and especially the topic of the principles ofdecent lawmaking. These principles are not enshrined in the Constitution of Poland itself, but the Constitutional Tribunal removes them from the principle of the rule of law. Among these principles, one of the most important is the principle of lex retro non agit (the law is not retroactive). The author shows the genesis of this principle, its regulatory framework and content, as well as exceptions, highlighting its important role in the legislative process.
